Competition Rules
Your Agreement to the Terms of this Competition
- Please read the terms and conditions below (“**Terms**”) carefully before you participate in the Competition listed in clause 1 of this Competition Schedule (the “Competition”). If You do not agree to these Terms, You must not participate in the Competition. By participating in the Competition, You agree to be bound by the Terms, which You agree to have read and understood
- Progressive Tech Holdings (Registration No. 117490 GBC), a company incorporated under the laws of Mauritius (“Ayoba”, “we”, “us” and “our”) makes the Ayoba digital platform(s) (the “Ayoba Platforms”) available for use in accordance with the Ayoba User Terms and Conditions and Privacy Policy (the “App Terms”). A copy of the App Terms is available at https://www.ayoba.me/web/terms-and-conditions. The Terms form part of the App Terms and govern your participation in the Competition. In the event of any conflict or inconsistency between the Terms and the App Terms, the Terms will apply to the extent of the conflict or inconsistency.
Entry Requirements
- In order to be eligible for participation in the Competition a participant (“Participant”, “You”, “Your”) must (i) be a South African citizen or permanent resident over the age of 18 (eighteen) years. Persons under the age of years may not participate in the Competition, unless they have received written consent to do so by their parent or legal guardian, which shall be provided to Ayoba upon request; (ii) successfully enter the Competition in accordance with the entry mechanism set out in clause 4 of the Competition Schedule; (iii) agree to permit Ayoba to collect and analyze Your personal information submitted to develop a database of customer product preferences. By entering the competition, You agree that your responses and any related data provided during Your participation in the Competition may be used for market research and personalised marketing purposes.
- You may only enter the Competition through the entry mechanism set out in the in clause 4 of the Competition Schedule and entries submitted via any other than mechanism will not be considered.
- Only entries received within the competition period will be considered. The Competition closes at midnight on the closing date as specified in clause 3 of the Competition Schedule and no other entries thereafter shall be considered.
Award Terms
- The prize winners shall be determined via random draw as set out in clause 8 of the Competition Schedule.
- All winners will be required to provide their names and contact details and to sign an acknowledgment of receipt of the prize.
- In the event that the prize winner cannot be successfully contacted within 24 hours of the final decision or is unable, for any reason whatsoever, to accept the prize, a replacement winner will be randomly drawn from the remaining qualifying participants in the draw in accordance with same process and procedures as applicable to the original draw.
- Ayoba reserves the right, at its sole discretion, to substitute the prize with any other prize of comparable or greater commercial value for whatever reason.
Award Terms
- The Personal Information collected and processed by Ayoba for the purpose of the Competition but not limited to the Competition draw, contacting of announcing winners shall be done in accordance with the laws of the Republic of South Africa and in line with the Ayoba Privacy Policy available at https://www.ayoba.me/web/privacy-policy. By entering this Competition and providing the required information, You agree that the Ayoba may use his/her personal information in connection with the Competition. you also agree for Ayoba to share the personal information with third parties for the purpose of the Competition.
Warranties and Indemnities
- Ayoba shall not be liable for and You hereby indemnify and hold Ayoba harmless from any claim, liability, cost, expense or penalty suffered or incurred by any person as a result of participating in the Competition.
- To the fullest extent permitted by law, the Competition is provided “as is” and on an “as available” basis with no representations or guarantees of performance or functionality of the Prizes. Participation in this Competition and subsequent use of a prize is at a Participant's and/or winner's own risk. Participants and winners hereby indemnify and hold harm less Ayoba against all claims, losses and liability whether direct or indirect incurred by any Participant or winner arising from or in connection with the Competition, including without limitation, personal injuries, death and property damage and claims based on publicity rights, defamation or invasion of privacy, howsoever arising.
- You understand and agree that communications sent over the internet are not guaranteed to be completely secure and may be subject to interception, monitoring, delay, disruption, loss, or alteration. We are not responsible for, and will not be liable for, any interception or monitoring of communications by third parties, or any delay or failure in transmitting communications.
General
- Ayoba may in its sole and absolute discretion amend the Terms at any time, by publishing the revised Terms on the Ayoba Platforms
- The Competition is not open to any director, member, partner, owner, employee, agent of, consultant to, or anyone associated with or affiliated Ayoba.
- You may not participate in the Competition fraudulently or unlawfully, or engage in suspicious activity. If we identify or reasonably suspect any fraud or suspicious activity, we may suspend or terminate your involvement in the Competition without prejudice to our rights under the App Terms or law.
- In the event of a dispute regarding any aspect of the Competition and/or the Terms, Ayoba’s decision will be binding and final and no correspondence will be entered into.
- Ayoba reserves the right to cancel, suspend or terminate the Competition at any time and without notice to the Participants
